Terms and conditions
Who is selling, how the contract is formed, when you pay and what can be returned. These terms cover buying a Dareczech piece through this site, through Instagram messages, by email, and in person wherever the pieces are on display.

I am not VAT registered, so the prices on the pieces are final.
I sell as a self-employed trader. Dareczech is designed and sewn by me, at home in Prague.
Who these terms apply to
If you are buying as a consumer – not on a business ID – Czech consumer law gives you rights on top of these terms. Nothing here takes any of them away.
If you are buying through a company or a business ID, the 14-day right to withdraw does not apply to you; the law gives it to consumers only.
How the contract is formed
A reservation on this site is not an order and not a contract. It is an enquiry, and an instruction to set the piece aside for you.
The contract is formed when I confirm your reservation by email and send the invoice. Until then you pay nothing and you are committed to nothing.
A reserved piece is held for 7 days from the invoice. If the payment does not arrive by then, the reservation lapses and the piece goes back into the collection.
Most pieces exist only once. Two people can occasionally reserve the same one within minutes; the first one stands, and I'll write to the other and suggest something similar.
Prices and payment
The price shown on a piece is the final price, all taxes included.
Payment is by bank transfer in Czech koruna only. No cards, no cash on delivery, no cash.
I email the invoice after your reservation and it is due in 7 days. The piece is sent or handed over once the full amount, postage included, has arrived.
Delivery and handover
- Collection in person in Prague: free, by arrangement. We settle the place and time by email. This is the cheapest delivery method I offer.
- Delivery within the Czech Republic: CZK 159. I post within three working days of the payment arriving.
- I do not normally post abroad. Write to me and I'll quote the postage up front.
Please check the parcel when you take delivery. If the packaging is damaged, record it with the courier there and then – it is hard to prove afterwards.
Custom pieces and alterations
A custom piece is one I start sewing to your brief: from your fabric, from your jacket or shirt, to your measurements, or from your idea.
A custom piece cannot be returned. Czech law excludes the right to withdraw for goods made to the consumer's specification or clearly personalised (§ 1837(d) of the civil code). We confirm this between us by email before I start.
The same applies when I alter a collection piece before sending it – shorten it, take it in, re-sew it, change a zip. The moment you ask for an alteration I'll write back and we'll confirm that the piece can no longer be returned.
Custom work takes a deposit, usually half the price. If you pull out of the brief, I am entitled to be paid for the material I have already bought and the work I have already done; I keep that much of the deposit and return the rest.
Buying a piece in person
Some pieces are on display away from this site as well – in a salon, at a market or at a pop-up. This section is about buying one there.
I am the seller there too, not whoever runs the place. You get an invoice from me with everything that belongs on it, and you can pay on the spot by bank transfer through a QR code.
The contract is formed right there, not at a distance. The 14-day right to withdraw therefore does not apply to that purchase – just as in any other shop where you look at something and buy it in person.
What does stay the same: I am liable for faults for two years and settle complaints within 30 days, exactly as for pieces bought through this site.
It is different if we only agree on the piece there and I post it to you afterwards. That is a distance purchase and the 14 days do apply.
Returning a piece from the collection
A collection piece you bought at a distance, that I did not sew to your brief and did not alter for you, can be returned within 14 days, no reason needed. This is how it works:
- The 14 days run from the day you, or whoever you nominate, take delivery. Collection in person counts the same way.
- Email me at info@dareczech.com within that time. Give your name, the invoice number and which piece you are returning. Any clear statement will do; there is a form at the bottom of this page if you want one.
- You then have 14 days from that email to send the piece back. The posting date is what counts.
- Return postage is yours to pay. The law allows this and I do not cover it.
- I do not accept cash-on-delivery parcels. Post the piece as an ordinary parcel to the address above, and do insure it – I am not liable for loss or damage on its way to me.
- Enclose a copy of the invoice, or at least its number. Without it I may not be able to tell whose parcel it is, and your refund will take longer.
What you get back
I refund to the account the payment came from, within 14 days of your withdrawal – but not before the piece reaches me and I have looked at it. The law allows me to wait (§ 1832(4) of the civil code).
The postage you paid to receive the piece is not refunded. The law requires me to refund delivery costs only up to the cheapest method I offer, and that is free collection in Prague.
Any loss in the value of the piece, as set out below, comes off the refund. I will always tell you what I deducted and why, with photographs.
What reduces the value of a returned piece
You can try a piece on at home, the way you would in a fitting room. Anything beyond that reduces its value, and that reduction comes off your refund (§ 1833 of the civil code).
With a handmade one-off the line is a sharp one. Each piece exists once and I have nothing to replace it with. If it comes back in a state I cannot sell to the next customer, the loss in value is the whole price and there is nothing to refund.
These things ruin a piece outright, so there is no point posting it back:
- washing, rinsing, dry-cleaning or ironing it, however well meant
- wearing it outside the house
- any alteration – shortening, taking in, re-sewing, changing a zip or buttons, including by someone else
- a lasting smell of perfume, smoke, food or animals
- stains, pulled threads, a split seam, a missing belt, strap or charm
These come off in part, by what it costs me to put the piece back as it was:
- a label cut off or torn out
- make-up, deodorant or fake tan on the lining and the hems
- pet hair and bobbling
- a piece posted back crumpled and without packaging
A deduction never exceeds the price of the piece. If we cannot agree on the amount, you can take it to the Czech Trade Inspection Authority – see below.
Faults and complaints
I am liable for faults for two years from delivery. Make a complaint by email to info@dareczech.com with photographs and your invoice number.
I'll settle it within 30 days and write to tell you how. If the fault can be mended, I'll mend the piece. If not, we'll agree on a reduction or a refund. I cannot make you the same piece again, because there is only one of it.
What is not a fault:
- small differences in measurements, in the shade of the fabric, or in where a pattern sits, compared with the photographs – a piece is handmade, not manufactured
- visible texture, patina or small irregularities in second-life material, where the piece's own description says so
- ordinary wear from being worn
- damage from the wrong care, from your own doing, or from an alteration by someone else
Every piece is photographed exactly as it is. What you see in the photographs and the description is a property of the piece, not a fault.
Disputes and supervision
If we cannot settle something between us, you can go to the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, adr.coi.cz. It costs you nothing, and you can start it within one year of first raising the matter with me.
Consumer protection is supervised by the Czech Trade Inspection Authority, data protection by the Czech Office for Personal Data Protection.
The EU online dispute resolution platform closed in July 2025, which is why there is no link to it here.
Finally
The contract is made in Czech and governed by the law of the Czech Republic.
The version of these terms you saw when you reserved is the one that applies. I can change them at any time, but that has no effect on contracts already made.
This English version is here for convenience. If anything reads ambiguously, the Czech version decides.
Withdrawal form
You do not have to use it – any clear statement by email will do. If it helps, copy this out and fill it in.
